By the time it's called off-spec, you no longer have the waste. You can't sample it, re-test it, or inspect it β€” it's their word about a drum that's gone, and an off-spec analysis is rarely produced unless you ask. Your only leverage is what you documented before it left your dock. So most sites accept the increase and keep working β€” fighting costs more than the fee. That isn't an accident; it's the design.

An off-spec charge shouldn't be unilateral. The facility should notify you, document the deviation with actual analysis, and agree the change with you before the price moves β€” and a rejected load has its own defined procedure, with discrepancies reconciled on the manifest (40 CFR 264.72). You're entitled to see the data behind the charge β€” and to question it. Most generators pay it simply because they have nothing to question it with.
